Terms of Service

These Terms of Service (ToS) apply to all legal transactions between NoRecoil.de and its customers, which are concluded through the website https://NoRecoil.de.

Deviating conditions of the customer are not recognized, unless NoRecoil.de expressly agrees to them in writing.

The use of the website requires compliance with applicable laws and the provisions of these ToS.

Customers may not use the website for illegal purposes or endanger the security of the platform.

NoRecoil.de offers digital products (e.g., software, VIP access, subscriptions, and other digital content).

All products are exclusively intended for private testing, research, learning, and analysis purposes.

The use of the products in online games, e-sports events, or on platforms whose rules prohibit this is the sole responsibility of the customer.

Customers can optionally create a customer account.

Registration requires the specification of a valid email address and the selection of a secure password.

The customer is obligated to treat their access data confidentially and not to pass them on to third parties.

NoRecoil.de assumes no liability for damages arising from improper use of access data.

The products presented on the website do not constitute a binding offer, but an invitation to submit an order.

A purchase contract is concluded when the customer submits an order and NoRecoil.de confirms this by email or by providing the product.

Before completing the order, all relevant costs (product price, taxes, possible additional costs) are displayed.

The contract text is not saved after contract conclusion; however, the customer receives a confirmation by email.

All prices stated on the website are in euros and include statutory value-added tax.

Payments are made exclusively through the payment methods specified on the website, in particular Stripe.

Stripe may collect additional information (e.g., device information) for fraud prevention. For details, see https://stripe.com/privacy.

The customer is obligated to ensure sufficient coverage of their payment method. Costs arising from chargebacks are borne by the customer.

Digital products are delivered electronically, usually by download or by provision through the customer account.

Delivery takes place immediately after receipt of payment, unless otherwise agreed.

No physical goods are shipped.

Consumers generally have a right of withdrawal of 14 days.

The customer is expressly informed before completing the order that their consent will result in the expiry of the right of withdrawal.

The customer undertakes to use the products only within the framework of legal provisions and these ToS.

It is particularly prohibited to:

• resell the products or transfer them to third parties without the consent of NoRecoil.de
• reproduce, modify, or commercially exploit content or software
• use products in a way that violates the rules of game providers or organizers

The customer is liable for damages arising from misuse.

All products, content, designs, and trademarks offered on the website are protected by copyright.

The customer receives only a simple, non-transferable right of use for private purposes.

Any use beyond this (e.g., publication, commercial use, processing) is prohibited without the express consent of NoRecoil.de.

NoRecoil.de is liable without limitation for intent and gross negligence.

In case of slight negligence, NoRecoil.de is only liable for damages from the breach of essential contractual obligations ("cardinal obligations"), limited to foreseeable damage.

The use of the products is at the customer's own risk.

NoRecoil.de warrants that digital products are free from material and legal defects at the time of delivery.

Defects must be reported by the customer immediately.

The claim for rectification or replacement delivery expires 12 months after provision of the product, provided the customer is a business. Consumer rights remain unaffected.

The protection of personal data is regulated in the privacy policy.

By concluding the purchase contract, the customer agrees to the processing of their personal data in accordance with GDPR.

Subscriptions or VIP access run for the respectively agreed duration.

Termination can be declared at any time before the end of the term, but only takes effect at the end of the contract period.

NoRecoil.de is entitled to terminate contracts without notice if the customer violates essential contractual obligations or these ToS.

Consumers have the option to contact the EU's online dispute resolution platform: https://ec.europa.eu/consumers/odr.

NoRecoil.de is not obligated and not willing to participate in a dispute resolution procedure before a consumer arbitration board.

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods.

The place of jurisdiction for disputes with merchants is the registered office of NoRecoil.de.

Should individual provisions of these ToS be invalid, the validity of the remaining provisions remains unaffected.

Changes to the ToS will be published on the website and come into effect three days after publication.
